Can foreigners buy property in Spain?
Yes, buyers of any nationality can purchase in Spain. You will need an NIE (a foreigner identification number for tax purposes) and, in practice, a Spanish bank account to complete the purchase and pay bills.
Can I still get a Golden Visa by buying property?
No. Spain closed its property-based Golden Visa route in April 2025, so buying a home no longer qualifies you for residency on its own.
What taxes are due when I buy?
On a resale home you pay transfer tax (ITP), set by the region; in Andalusia, which includes Marbella, it is 7%. On a new build bought from a developer you pay 10% VAT plus stamp duty (AJD), 1.2% in Andalusia. Allow a further 1% to 2% for notary, land registry and legal fees.
How does the buying process work?
You pay a reservation deposit, then sign a private purchase contract (often an "arras" contract with a deposit of around 10%), and complete by signing the title deed before a notary, after which the purchase is registered at the Land Registry. An independent Spanish lawyer should check the title and planning status before you commit.
Are off-plan deposits protected?
Spanish law requires developers to protect deposits paid on homes under construction with a bank guarantee or insurance policy, so the money is returned if the home is not delivered. Ask for the guarantee certificate for every payment you make.
